Terms of Use

These Terms of Use (hereinafter referred to as these "Terms") define the terms and conditions of use for the services (hereinafter referred to as the "Services") provided by the National Institute of Informatics (hereinafter referred to as the "Institute") on this website. The users (hereinafter referred to as the "Users") are requested to use the Services in accordance with the Terms.

Article 1 (Scope)

  1. These Terms shall apply to all matters related to the use of the Services between the Users and the Institute.
  2. Upon commencement of the use of the Services, the Users shall be deemed to have agreed to these Terms.

Article 2 (Usage Fees and Payment Methods)

There is no charge for using the Services.

Article 3 (Prohibitions)

In using the Services, the Users must not engage in any of the following actions:

  • Violation of laws and regulations or public order and morals;
  • Action related to criminal offences;
  • Infringement of copyrights, trademarks or other intellectual property rights contained in the Services, including the content of the Services;
  • Destruction or interference with the functionality of the server or network of the Institute, other Users or any other third parties;
  • Actions that may interfere with the operation of the Institute's services;
  • Unauthorized access or attempt to gain unauthorized access;
  • Collection or accumulation of personal data about other Users;
  • ○ Directly or indirectly providing benefits to antisocial forces in relation to the Services of the Institute; or
  • Any other actions deemed inappropriate by the Institute.

Article 4 (Termination of Service Provision, etc.)

  1. The Institute may, in its sole discretion, terminate or suspend the provision of all or part of the Services without prior notice to the Users for any of the following reasons:
    1. Maintenance, inspection or updating of computer systems related to the Services;
    2. In the event of difficulties in providing the Services due to force majeure such as earthquake, lightning, fire, power outage or natural disasters;
    3. Accidents resulting in the shutdown of computers or communication lines, etc.; or
    4. Any other cases deemed difficult to provide the Services by the Institute.
  2. The institute shall not be liable for any disadvantage or damage caused to the Users or any third party as a result of the termination or suspension of the provision of the Services.
  3. Services linked to the Services may be terminated without prior notice. The Institute shall not be liable for any loss or inconvenience caused by the termination of the linked services.

Article 5 (Restriction on Use and Cancellation of Registration)

  1. The Institute may, without prior notice, restrict the Users from using all or part of the Services if the Users fall into any of the following:
    1. 1. In case of a violation of any of the provisions of these Terms; or
    2. Any other cases deemed inappropriate for the use of the Services by the Institute.
  2. The Institute shall not be liable for any damages caused to the Users as a result of any action taken by the Institute under this Article.

Article 6 (Disclaimer of Warranties)

  1. The Institute makes no warranty, express or implied, that the Services are free from defects, whether in fact or in law (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security or other defects, errors or bugs, or infringement of rights).
  2. The Institute shall not be liable for any and all damages caused to the Users as a result of the Services. However, this disclaimer shall not apply if the agreement between the Institute and the Users regarding the Services (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.
  3. Notwithstanding the provisions stated in the proviso to the preceding paragraph, the Institute shall not be liable for any damage caused to the Users arising from special circumstances (including cases where the Institute or the Users foresaw or could have foreseen the occurrence of the damage), which is caused by default or tort due to the negligence (excluding gross negligence) of the Institute.
  4. The Institute shall not be liable for any transactions, communications or disputes between the Users and other Users or third parties arising out of or in connection with the Services.

Article 7 (Changes to the Service Content, etc.)

The Institute may change the content of the Services or discontinue the provision of the Services without notice to the Users, and shall not be liable for any damage caused to the Users as a result of such changes or discontinuation.

Article 8 (Amendments)

The Institute reserves the right to change these Terms at any time without notice to the Users if it deems it necessary. The commencement of the use of the Services after a change to these Terms shall be deemed to constitute acceptance of the amended Terms by the Users.

Article 9 (Handling of Personal Data)

The Institute shall appropriately handle individual information collected via the use of the Services in accordance with the Institute's Privacy Policy

Article 10 (Notification or Communication)

Notifications or communications between the Users and the Institute shall be carried out in the manner specified by the Institute.

Article 11 (Governing Law/Jurisdiction)

  1. These Terms shall be governed by and interpreted in accordance with Japanese law.
  2. These Terms shall be only valid in their original form in Japanese, and any other language versions are translations and for reference purposes only and shall have no legal effect or influence whatsoever.
  3. Any dispute arising out of or in connection with the Services shall be subject to the exclusive jurisdiction of the court that has jurisdiction over the location of the Institute.
